Terms of Service
Last updated: [To be supplied: Effective date]
These terms explain the rules for using OgaLandlord, what you can expect from us and what we expect from you. Please read them before you create an account.
Draft wording
This page is a draft. It must be reviewed and approved by legal counsel before OgaLandlord is used in production. Text marked “To be supplied” is still missing.
1. Who these terms are between
These terms are an agreement between you and [To be supplied: Registered company name] (registration number [To be supplied: CAC RC number]), whose registered office is at [To be supplied: Registered office address] (“we”, “us”). We run OgaLandlord.
If you use OgaLandlord for a business or organisation, you accept these terms for that organisation and confirm you have authority to do so.
By creating an account or using the service you agree to these terms and to our Privacy Policy.
2. The service
OgaLandlord is software for managing rental property in Nigeria. It lets landlords, property managers and agencies record properties, apartments, tenants, leases, rent payments, expenses and maintenance issues, and produce owner statements. Tenants get a portal to see their lease, pay rent and report issues. Agents get profiles and referral tracking. The service also includes a public marketplace of listings and agents.
We may change, add or remove features over time. If we remove a feature that is part of a paid plan you are on, we will tell the account owner first.
3. Accounts and roles
- You must give accurate details when you register and keep them up to date.
- You are responsible for keeping your password and any two-factor backup codes safe, and for everything done through your sign-in.
- An organisation's account has an Account Owner. The Account Owner can invite team members and give them roles, such as Property Manager or Caretaker, each with its own permissions.
- The Account Owner is responsible for the people they invite, for the roles and permissions they give them, and for what those people do in the account.
- Tell us straight away through our contact page if you think someone has used your account without permission.
4. Acceptable use
You must not:
- break any law, including Nigerian data protection and consumer protection law;
- add personal data about other people unless you have a lawful basis to do so and have told them as the law requires;
- publish false, misleading or discriminatory listings, reviews or profiles;
- try to get into accounts, organisations or data that are not yours;
- test, probe or attack the security of the service, or overload it, without our written permission;
- upload malware or content you do not have the right to share;
- copy, resell or reverse engineer the service, except where the law allows.
5. Your data
You, or the organisation you work for, own the data you put into OgaLandlord. We do not claim ownership of it.
You give us permission to store, copy and process that data only as needed to provide, secure and support the service, and as described in our Privacy Policy.
When you add data about tenants, guarantors, owners or other people, your organisation is the data controller for it and is responsible for having a lawful basis to use it. We act as your data processor for that data.
You can request an export of your personal data from the data management page.
6. Subscriptions and billing
- OgaLandlord has a Free plan and paid plans. Current plans and prices are on the pricing page.
- Paid plans are billed in Nigerian naira (NGN) and paid through Paystack.
- A paid plan renews at the end of each billing period and is charged to the saved payment method. If a charge fails, we email the Account Owner and may try the charge again. If it is still unpaid 21 days after it was due, the paid subscription ends and the account is put on the Free tier. Nothing is deleted.
- Only the Account Owner can cancel a subscription. They do this on the billing page.
- When you cancel, you keep your plan until the end of the period you have paid for. If you cancel during a free trial, the trial ends on its trial end date and you are not charged.
- After that date the account moves to the Free plan. Nothing is deleted. Features and limits that are not part of the Free plan stop applying.
- Refunds: [To be supplied: Refund policy].
Agents can pay a one-off fee to get a verified badge on their profile. The fee is shown before you pay and is paid through Paystack.
7. Rent payments
Tenants can pay rent online through Paystack from the tenant portal. Paystack processes these payments under its own terms. Landlords and managers can also record payments made by other means.
The tenancy is an agreement between the landlord (or their manager) and the tenant. We are not a party to it. We do not set rent, hold deposits, decide disputes or guarantee that any party meets its obligations. Landlords are responsible for their lease terms and for following the law that applies to their tenancies.
8. Third-party services
Parts of the service rely on other companies, including Paystack for payments, Smile ID for identity checks, and providers for SMS, WhatsApp and email messages. Their own terms apply to what they do. We are not responsible for their services, but we choose them with care and only share what they need.
9. Suspension and termination
You can stop using OgaLandlord at any time. The Account Owner can cancel a paid plan as described above.
We may suspend or close an account, or a user's access, if it breaks these terms, puts other users or the service at risk, or if the law requires it. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
If an account is closed, we keep and delete its data as our Privacy Policy describes.
10. Disclaimers
We work to keep OgaLandlord running and accurate, but we provide it “as is” and “as available”. We do not promise that it will always be available or free of errors.
Figures, reports and statements are produced from the data entered into the service. They are not financial, tax or legal advice. Check important figures before you rely on them.
Listings, reviews, profiles and verification badges reflect information from users and third parties. A verified badge shows that a check was completed. It is not a recommendation.
11. Limitation of liability
Nothing in these terms limits liability that cannot be limited under Nigerian law.
Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill. Our total liability to you for all claims connected with the service is limited to [To be supplied: Liability cap].
12. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. Disputes will be decided by the courts of [To be supplied: Venue city or state for disputes].
13. Changes to these terms
We may update these terms. We will change the “Last updated” date at the top of this page and tell account holders about significant changes before they take effect. If you keep using the service after a change takes effect, the new terms apply.
